What is an OMC director portal?
An OMC director portal is a live view of the Owners' Management Company for its volunteer directors: the client-account balance, spend against each budget line, open work and its status, and the compliance evidence behind every obligation. Instead of a summary PDF a couple of times a year, the board sees the real position whenever it logs in, which is what governing a company properly actually requires.
What are an OMC director's responsibilities in Ireland?
OMC directors are company directors under the Companies Act 2014 and carry the multi-unit duties of the MUD Act 2011: maintaining the service charge and sinking fund, holding the annual meeting, keeping the development insured and compliant, and acting in the members' interests. They are usually unpaid volunteers, so the practical challenge is oversight without drowning in detail. A live portal gives them the oversight without the grind. Can an OMC name owners who are in arrears?
Generally no. The Data Protection Commission has indicated that there is usually no lawful basis for disclosing individual members' service-charge payment details to the wider membership. That is why Cuan shows directors arrears in aggregate by default, the total and the ageing, which is what the board needs to govern. Named detail is possible only where a lawful basis exists, and every such disclosure is logged.
How is a director portal different from the twice-a-year PDF?
A PDF is out of date the moment it is printed and shows only what the agent chose to include.
